Prohibiting the Use of Compression (Jake) Brakes - City of Lancaster
AN ORDINANCE PROHIBITING THE USE OF COMPRESSION BRAKES IN THE CITY OF LANCASTER, WISCONSIN, PROVIDING PENALTIES THEREFORE AND AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO POST APPROPRIATE SIGNS
WHEREAS, the City Council of the City of Lancaster, Wisconsin, finds that the use of motor vehicles brakes which are activated or operated by the compression of the engine of a motor vehicle disturbs and disrupts the public peace and quiet and, therefore, finds that it would be in the best interest of public health, safety and general welfare to prohibit the use of such brakes within the city limits of the City of Lancaster;
NOW THEREFORE THE CITY COUNCIL OF THE CITY OF LANCASTER, WISCONSIN DO ORDAIN AS FOLLOWS:
Section 1. Section 7.15 of the ordinance of the City of Lancaster is hereby created to read as follows:
7.15 COMPRESSION BRAKES PROHIBITED.
No person shall use motor vehicle brakes within the city limits of the City of Lancaster which are in any way activated or operated by the compression of the engine of any such motor vehicle or any unit or part thereof
Section 2. Any person violating the provisions of this ordinance shall have committed a traffic offense and a penalty shall be imposed as provided in Section 7.20 (2) of the ordinances of the City of Lancaster.
Section 3. The Director of Public Works is authorized and directed to post appropriate signs consistent with the provisions of this ordinance.
Section 4. All other terms and provisions of Chapter 7 shall remain in full force and effect unless specifically modified herein.
Section 5. This ordinance shall take effect the. day after passage and publication as provided by law.
