Creating a Utility Commission - Village of Hustisford
ORDINANCE CREATING UTILITY COMMISSION TO GOVERN THE ELECTRIC, SEWER AND WATER UTILITIES
WHEREAS, the Village of Hustisford has for many years owned and operated an electric utility under the commission form of governments, and
WHEREAS, the Village Board deems it to be beneficial for the sewer and water utilities to be run under a combined commission.
NOW, THEREFORE, the Village Board of the Village of Hustisford so ordains as follows:
1. Section 2.4-4 of the Hustisford Municipal Code entitled "Utility Commission" is amended to read as follows:
SEC. 2-4-4 UTILITY COMMISSION
(a) Composition. The utility Commission for the Village shall consist of five (5) members who shall be appointed on a non-partisan basis by a majority of the members of the village Board for a term of five (5) years. The terms of the commissioner shall expire successively in each year on October 1st.
(b) Eligibility.
(1) One member of the village Board shall, during the term of which he is elected, be eligible for a position on the utility Commission.
(2) All members of the utility commission shall be residents of the village of Hustisford.
(3) No person shall be eligible for the position of utility commissioner or hold any office or position in such department who directly or indirectly has pecuniary interest in any contract for furnishing heat, light, water, power, or other public service to or for such village, or who is a stock holder in any corporation which has any such contract. Any such office or position shall become vacant upon the acquiring of any such interest.
