Elections FAQ 6

What constitutes "a misdemeanor involving a violation of public trust” under section 3, article XIII of the Wisconsin Constitution?

Pursuant to section 3, article XIII of the Wisconsin Constitution anyone convicted of a felony or "a misdemeanor involving a violation of public trust" is disqualified from being placed on a ballot for elective office. However, Wisconsin law does not presently designate any misdemeanors as misdemeanors involving a violation of public trust. Therefore, the ineligibility for misdemeanants created by the recent change to the Wisconsin Constitution will not be effective until the Wisconsin legislature designates some misdemeanors as misdemeanors involving a violation of public trust.
