Disturbance of Refuse Containers - City of Eau Claire
AN ORDINANCE TO AMEND CHAPTER S. 32 ENTITLED "REFUSE COLLECTION AND DISPOSAL" AND CHAPTER 16.08 ENTITLED "HOUSING CODE" OF THE CODE OF ORDINANCES OF THE CITY OF EAU CLAIRE
THE CITY COUNCIL OF THE CITY OF EAU CLAIRE DO ORDAIN AS FOLLOWS:
SECTION 1. That s. 8.32.123, entitled "Disturbance of refuse containers," is hereby created to read as follows:
8.32.125 Disturbance of refuse containers. No person shall open or disturb any refuse bag or container in a manner that would cause or contribute to litter.
SECTION 2. That s. 8.32.170, entitled "Collections," is hereby amended as follows:
Subsection E. thereof is repealed and recreated to read as follows:
E. The hours and days of collection stated in this chapter may be altered or extended for a reasonable time by the health director or that person's designee under special circumstances which in the opinion of that person are likely to affect the health, safety or welfare of persons or the community. Extensions may be city-wide or restricted to designated areas.
Subsection F. 2. thereof is amended to read as follows:
2. All collections under this subsection shall be made from a container having a composition as provided under subsection A. All containers shall be provided to the customer without charge by the customer's hauler and the container shall contain the name of the hauler in a manner which is readily identifiable from the right of way adjacent to the location of collection. The health director or that person's designee may allow plastic bags and other refuse items to be placed curbside for collection under special circumstances which in the opinion of that person are likely to affect the health, safety or welfare of persons or the community. However, collection of these items shall conform to schedules set by the health department and the bags shall comply with specifications determined by the health department.
Subsection F. 6. thereof is amended to read as follows:
6. Curbside refuse collection shall be permitted on weekdays during the last full week in April and the third full week in October without compliance with paragraphs 1 through 7 of this subsection, provided no charge is imposed for such collection and such collection is made in conjunction with a city-wide collection of refuse by a licensed hauler.
SECTION 3. That s. 16.08.110, entitled "Responsibilities of owners and occupants," Is hereby amended as follows:
Subsection C. thereof is amended by numbering the existing text as and adding thereto subsection 2. to read as follows:
2. It shall be the responsibility of the owner of a dwelling to supply containers for all dwelling units in a dwelling containing more than two dwelling units and for all dwelling units located on premise where more than two dwelling units share-the same premises, except as otherwise provided by chapter 8.32. In all other cases it shall be the responsibility of the occupant to furnish such containers, except as otherwise provided by chapter 8.32.
Subsection D. thereof is repealed and recreated to read as follows:
D. Every owner of a dwelling shall assure adequate refuse service and collection for that dwelling consistent with the provisions of this chapter and chapter 8.32 of this code.

THE CITY COUNCIL OF THE CITY OF EAU CLAIRE DO ORDAIN AS FOLLOWS:
