ORDINANCE NO 1772
AMENDING THE MARINETTE ZONING CODE TO ELIMINATE POSTER PANELS AS A PERMITTED PRINCIPAL USE IN B-1 LOCAL SHOPPING DISTRICTS AND LISTING THEM AS SPECIAL EXCEPTIONS IN B-2 COMMERCIAL, B-3 HIGHWAY BUSINESS, I-1 LIGHT INDUSTRIAL AND I-2 HEAVY INDUSTRIAL ZONING DISTRICTS
Based upon a recommendation and report of the Plan Commission at its meeting on July 9, 1998, and following a public hearing by the Common Council on August 4, 1998, the Common Council of the City of Marinette, Wisconsin do ordain as follows: (All references are to the Marinette Municipal Code.)
Section 1. Section 13-3-6(c) shall be repealed.
Section 2. Section 13-3-7(b) shall be repealed. The language found in former Section 13-3-2(a)(10) shall then be further amended by adding the following language at the end: These are minimum requirements. The plan commission may impose more stringent requirements or deny the request for a poster panel altogether through the special exception process.
Section 3. "Poster Panels/Billboards" shall be added as Special exceptions in the following zoning classifications and the existing list of special exceptions in each zoning classification shall be renumbered where appropriate: Section 13-1-14(e) B-2 Commercial District; Section 13-1-15(e) B-3 Highway Business District; Section 13-1-16(e) I-1 Light Industrial District; Section 13-1-17(e) I-2 Heavy Industrial District.
Section 4. The provisions of this ordinance are declared to be severable. If any section, sentence, clause, phrase, or application of this ordinance is held to be invalid or unconstitutional for any reason, such decision shall not affect the validity of the remaining sections, sentences, clauses, phrases, or applications of this ordinance, which shall remain in effect. It is the legislative intent that this ordinance shall remain in effect notwithstading the invalidity of any part or application of this ordinance.
Section 5. This ordinance shall take effect upon passage and publication as provided by law.
