Smoke Detectors - City of Superior
AN ORDINANCE TO AMEND CHAPTER 14, FIRE PREVENTION AND PROTECTION, SECTION 14-33, INSTALLATION AND MAINTENANCE, OF THE CITY CODE OF ORDINANCES.
The Common Council of the City of Superior, Wisconsin, does ordain as follows:
SECTION 1: Section 14-33, Installation and Maintenance, of the Code of Ordinances of the City of Superior, Wisconsin, is hereby amended to read as follows:
Section 14-33. Installation and Maintenance.
(a) A smoke detector required under this article shall be installed according to tile directions and specifications OF THE manufacturer and maintained in good working order. The owner of the premises shall be responsible for the installation and maintenance of a smoke detector required under this article. The Chief of the Fire Department and the Building Inspector or their duly appointed representatives shall, at the request of an owner, provide guidance in determining the locations of a smoke detector required under this article.
(b) Effective July 1, 2000, all rental property with living units, when leased, shall have new batteries installed in smoke detectors and the same shall be noted on the lease agreement signed by both the owner (or agent) and the tenant. Property owner or agent shall change batteries as required by manufacturers recommendations and records shall kept as to date of service.
SECTION 2: All ordinances and parts of ordinances in conflict herewith are hereby repealed.
SECTION 3: If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be invalid or unconstitutional by reason of any decision of any court of competent jurisdiction, such decision shall not affect the validity of any other section, subsection, sentence, clause or phrase or portion thereof.
SECTION 4: This ordinance shall take effect and be in force from and after its passage and publication, as provided by law.
