Licensing Massage Therapists and Bodyworkers - Village of Hales Corners

AN ORDINANCE REQUIRING THE STATE OF WISCONSIN REGISTRY OF MASSAGE THERAPISTS AND BODYWORKERS

WHEREAS, 1997 Wisconsin Act 156 created Subchapter XI (as renumbered by the revisor) of Chapter 440 (as renumbered by the revisor) of the Wisconsin Statutes, providing for the registration and regulation of massage therapists and bodyworkers, effective February 1, 1999;

WHEREAS, the Village Board having reviewed such registration and regulation requirements and having determined same to be reasonable minimum requirements for any person to engage in the practice of massage therapy or bodywork within the Village.

NOW, THEREFORE, the Village Board of the Village of Hales Corners, Wisconsin, do ordain as follows:

SECTION 1: Sec. 11.19 of the Municipal Code of the Village of Hales Corners, Wisconsin, be and the same is hereby created to read as follows:

11. 19 REGISTRY OF MASSAGE THERAPISTS AND BODYWORKERS REQUIRE No person or entity shall engage in the practice of massage therapy or bodywork or perform massage therapy or bodywork for gain, unless such person has previously been issued and holds a valid license of registration under Subchapter XI of Chapter 440 of the Wisconsin Statutes, as amended.

SECTION 2: The terms and provisions of this ordinance are severable. Should any term or provision of this ordinance be found to be invalid by a court of competent jurisdiction, the remaining terms and provisions shall remain in full force and effect.

SECTION 3: All ordinances and parts of ordinances in contravention to this ordinance are hereby repealed.

SECTION 4: This ordinance shall take effect and be in force from and after its passage and publication, excepting as to any person or entity engaged in the practice described under Section 1 prior to the date of passage of this ordinance but not holding a valid license as described thereunder, as to such person or entity, considering the requirements set forth under §440.982(l)(b), Stats., this Ordinance shall take effect and compliance herewith shall be had on or before October 1, 2000.
